This Privacy Policy explains how The Kind Relief Inc. (Arizona) and Element MD, LLC (Maryland), together doing business as Melted ("Melted," "we," "us," or "our"), collect, use, disclose, and protect information about you when you visit lovemelted.com (the "Site") or interact with our email and text-message programs. The Kind Relief Inc. and Element MD, LLC act as joint controllers of the personal information described in this Policy and are jointly responsible for how it is handled. By using the Site or opting in to our communications, you agree to this Policy.
The Site and our products are intended only for adults twenty-one (21) years of age or older. We do not knowingly collect information from anyone under 21. If you are under 21, do not use the Site or provide us any information.
We do not sell cannabis on this Site. Melted products are sold only at licensed third-party dispensaries. The Site is informational and directs you to those dispensaries; any purchase you make happens on the dispensary's own systems, subject to the dispensary's privacy practices, not ours.
1. Information We Collect
Information you provide
- Account and contact details — such as your name, email address, and mobile phone number when you create an account or sign up for updates.
- Marketing preferences and consent records — whether you opted in to email and/or SMS, and, to document your consent, the date and time, the exact consent language shown to you, and the IP address associated with the opt-in.
- Communications — information you include when you contact us (e.g., partner, licensing, or support inquiries).
Information collected automatically
- Device and usage data — such as IP address, browser type, device type, pages viewed, and referring pages, collected through standard web logs and our hosting provider.
- Local storage — we store a small flag in your browser to remember that you confirmed you are 21+ (melted_age_ok) and, if you sign in, basic session information (melted_user). These are not advertising cookies.
Information from third parties
- Sign-in providers — if you choose "Continue with Google" or "Continue with Apple," that provider shares limited profile information (such as your name and email) after you authenticate. We never receive your Google or Apple password.
2. How We Use Information
- To create and manage your account and verify you are 21 or older.
- To send the email and/or text-message updates you requested, including product news, promotions, and dispensary availability.
- To respond to your inquiries and provide customer, partner, and licensing support.
- To operate, secure, maintain, and improve the Site.
- To comply with legal obligations, including recording marketing consent for regulatory purposes.
3. Email and SMS Marketing
You may opt in to receive marketing emails and/or recurring marketing text messages from Melted. Opt-in is separate for each channel and is never a condition of any purchase.
Text messages. If you consent to SMS, you agree to receive recurring automated marketing text messages (our "Melted's Latest" program) at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to any message to cancel, or HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase.
Email. Every marketing email includes an unsubscribe link. You can withdraw consent at any time.

4. How We Share Information
We do not sell your personal information. We share information only as described here:
- Service providers who act on our behalf under contract — including our website host, our email marketing provider, our text-message provider, and our sign-in providers (Google, Apple). They may use your information only to provide services to us.
- Legal and safety — when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Melted, our customers, or others.
- Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
The Site also loads content from third parties whose own privacy practices apply, including web-font delivery, styling libraries, and the interactive map used in our store locator. Links to dispensary menus lead to third-party sites we do not control.
5. Your Choices and Rights
- Marketing opt-out — unsubscribe from emails via the link in any email, or reply STOP to any text message.
- Account information — you may request access to, correction of, or deletion of your account information by contacting us at info@lovemelted.com.
- Browser controls — you can clear local storage and cookies through your browser settings.
Depending on where you live, you may have additional rights under state privacy laws (for example, to know, access, correct, delete, or limit certain uses of your personal information, and to be free from discrimination for exercising those rights). Because we do not sell personal information or use it for cross-context behavioral advertising, we do not offer a "Do Not Sell or Share" sale opt-out; where required, we honor recognized opt-out preference signals. 6. Data Retention
We keep personal information for as long as needed to provide the Site and communications you requested, and thereafter as required to meet legal, tax, or regulatory obligations — including retaining marketing consent records for the period required by applicable telemarketing and consumer-protection law. When no longer needed, we delete or de-identify it.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
8. Children
The Site is not directed to anyone under 21, and we do not knowingly collect information from anyone under 21. If you believe a person under 21 has provided us information, contact us at info@lovemelted.com and we will delete it.
9. Third-Party Sites
The Site links to dispensary menus and other third-party sites. We are not responsible for their content or privacy practices. Review the privacy policy of any site you visit.
10. Changes to This Policy
We may update this Policy from time to time. We will post the updated version here and revise the "Last updated" date above. Material changes will be identified as appropriate.
