Terms of Service

These Terms of Service ("Terms") govern your access to and use of lovemelted.com (the "Site"), operated by The Kind Relief Inc. (Arizona) and Element MD, LLC (Maryland), together doing business as Melted ("Melted," "we," "us," or "our"). By accessing or using the Site, or by opting in to our messaging programs, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Eligibility
You must be at least twenty-one (21) years of age to use the Site. By using the Site you represent and warrant that you are 21 or older. The Site is intended for use within the United States, in jurisdictions where cannabis is lawful for adults.
2. What This Site Is — and Isn't
The Site is a brand and informational resource. Melted does not sell, deliver, or ship cannabis or cannabis products through the Site. Melted products are available only at licensed third-party dispensaries. When you use our store locator or "Order Online" links, you are directed to a dispensary's own website or menu, operated by that dispensary and governed by its own terms and policies. Product availability, pricing, and fulfillment are determined by the dispensary, not by Melted.
Any branded merchandise offered through the Site (when available) may be sold and fulfilled by a third-party provider and is subject to that provider's separate terms and policies in addition to these Terms.
3. Accounts
If you create an account, you agree to provide accurate information and to keep your credentials secure. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
4. Cannabis Notices and No Medical Claims
Cannabis products may be purchased and used only by adults 21 and older (or qualifying patients where applicable) and only through licensed dispensaries in accordance with state law. Cannabis products can impair concentration, coordination, and judgment; do not operate a vehicle or machinery under the influence.
Information on the Site is provided for general and educational purposes only and is not medical advice. Statements about our products have not been evaluated by the U.S. Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare provider with questions about your health.
Arizona
Do not use marijuana if you are under twenty-one years of age or pregnant. Keep marijuana out of reach of children.
Maryland
The contents of Melted products may only be lawfully consumed by a consumer 21 years old or older, or a registered medical cannabis patient. Consumption of cannabis may impair your ability to drive a car or operate machinery — please use extreme caution. There may be health risks associated with cannabis use, especially if pregnant or breastfeeding.
5. Messaging Programs (Email and SMS)
By opting in, you consent to receive marketing communications in the channel(s) you select. Opt-in is separate for email and text messaging and is not a condition of any purchase.
SMS. By providing your mobile number and opting in to Melted's Latest, you agree to receive recurring automated marketing text messages from Melted at that number. Message frequency varies. Message and data rates may apply. Reply STOP to cancel and HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase.
Email. You may unsubscribe at any time via the link in any marketing email.
Your use of these programs is also governed by our Privacy Policy.
6. Acceptable Use
You agree not to: use the Site if you are under 21; misrepresent your identity or age; interfere with or disrupt the Site or its security; access the Site by automated means without our permission; or use the Site for any unlawful purpose.
7. Intellectual Property
The Site and its content — including the MELTED name and wordmark, the M monogram, the tiger marks, the swirl texture, and all text, graphics, photography, and design — are owned by or licensed to Melted and are protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission.
8. Third-Party Links
The Site contains links to third-party sites, including dispensary menus and ordering platforms. We do not control and are not responsible for the content, products, or practices of those sites. Your use of them is at your own risk and subject to their terms.
9. Disclaimers
The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information (including dispensary availability or pricing) is accurate or current.
10. Limitation of Liability
To the fullest extent permitted by law, Melted and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or relating to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Melted and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.
12. Changes
We may modify these Terms at any time by posting the revised version here and updating the "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Arizona for any dispute arising out of or relating to these Terms or the Site.
14. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Melted regarding the Site.
